Pay.com.au Refer and Earn Promotion Terms and Conditions
- These terms and conditions (the “Rules”) apply to the refer and earn promotion (“Promotion”). By participating in the Promotion, you agree to be bound by these Rules. Any terms below that are capitalised but not otherwise defined have the same meaning as set out in the pay.com.au Platform Terms & Conditions (“Terms & Conditions”).
- To qualify for the Promotion, the person making the referral (“you”) must be an existing member with Pay.com.au Limited (“we”, “us”, “pay.com.au”) and have an active and existing Pay.com.au account that is not suspended or otherwise in default.
- You must have an existing business or personal relationship with the person you would like to refer (the “referral”). The referral must be eligible to open a Pay.com.au Account in accordance with clause 2 of the Terms & Conditions.
- To make a referral, you must share the referral code or unique link provided to you at app.pay.com.au/refer (“Unique Link”).
- You must not:
- provide or publish any information, or make any representation about the Promotion to any person, other than by sharing the unique link provided to you by Pay.com.au;
- attempt to refer any person to Pay.com.au for the purposes of the Promotion if that person has made you aware that they do not wish to participate; or
- represent to any person that you are an agent or representative of Pay.com.au.
- The referral must be a new client of Pay.com.au (not having previously held an account with Pay.com.au). All account applications are subject to our standard account opening criteria and will be governed by the Terms & Conditions.
- To qualify for the Promotion, the referral must:
- be approved for and open a fully verified Pay.com.au account (pay.com.au Account) using your Unique Link during registration;
- make a total of $10,000 or more of Eligible Payments via the Platform within 30 days of being fully verified ; and
- meet any other eligibility requirements as may apply to the Promotion from time to time, in accordance with details laid out at app.pay.com.au/refer,
(together, a “Successful Referral”)
- You must not represent to any person that a referral under this Promotion is required in order to apply for a Pay.com.au Account.
- If any restrictions, conditions or account suspensions apply to the operation of your Pay.com.au Account or the Pay.com.au Account of the referral, the referral will not qualify as a Successful Referral until any such restrictions, conditions, or suspensions have been removed.
- The amount of bonus PayRewards Points that both You and (if applicable) your Successful Referral will receive (including any milestone bonuses) will be in accordance with the referral bonus rates applicable at the time Your Referral registers with your unique link or code, which can be found at app.pay.com.au/refer.
- We reserve the right to amend the Promotion, any benefits received under the Promotion, and the relevant eligibility criteria at in our sole discretion.
- If the referral qualifies as a Successful Referral, we will allocate the Bonus PayRewards Points to both you and (if applicable) the referral within [30 days] of qualification.
- We will not provide any payment, commission or reward of any type in connection with the Promotion unless specifically set out in these Rules.
- You will only be eligible to receive the Bonus PayRewards Points once per Successful Referral; however, the number of referrals you can make is not capped.
- Where we consider that any of these Rules have been breached or there is any reason to suspect any participant has acted dishonestly, fraudulently or obtained an unfair or unintended advantage in connection with the Promotion, we reserve the right to stop or withdraw the allocation of Bonus PayRewards Points to any person involved without notice.
- We are the sole arbiter of the Promotion and these Rules. Any decisions about the application of these Rules are at the sole discretion of Pay.com.au, and our decision is final. We reserve the right to alter, amend or terminate the Promotion or any aspect of these Rules at any time by providing 5 days’ prior notice, either via the Platform, Website, email or other communication channel we deem appropriate.
- We will not be held liable for any losses incurred by any person in connection with their participation in the Promotion.
- Any dispute or situation not covered by these Rules will be resolved by Pay.com.au in a manner it deems to be fairest to all concerned, and that decision shall be final and binding on all parties.
- If at any time all or any part of any provision of these Rules are or become illegal, invalid or unenforceable, such provision(s) shall not affect or impair the legality, validity or enforceability of the remainder of that provision or all other provisions of these Rules.
- These Rules shall be governed by and construed in accordance with the laws of Victoria, Australia and shall be subject to the exclusive jurisdiction of the Victorian courts.
